Terms of Service
These terms govern meshyflix.com: buying 3D models in the shop, buying tokens, and using tokens to generate models in the studio. The Licensing page, the Refunds and withdrawal page and the price and token figures shown on the site form part of them.
1. Who we are and scope
The site is operated by:
[Company legal name]
[Registered address]
[Commercial register and number] · VAT ID [VAT ID]
Represented by [Managing director / owner]
Email: info@meshyflix.com
These terms apply to every contract concluded through the site, with consumers and with businesses. A consumer is anyone who buys for purposes outside their trade, business or profession. Terms of a customer that differ from these do not apply.
2. Your account
The studio, the token wallet and your downloads need an account. You must be able to enter into a binding contract — of legal age, or with the consent of a parent or guardian. Give accurate details, keep your password to yourself and tell us if you think someone else has used your account. One account belongs to one person.
You can delete your account at any time from the studio’s account settings; section 4 of the Privacy Policy explains what that removes. We may suspend an account that breaches these terms — where reasonable, after telling you why and giving you a chance to put it right.
3. Ordering and the contract
Products and token packs shown on the site are an invitation to order, not a binding offer. You add items to the cart, enter your billing details, review the order, accept these terms and press Buy now; that is a binding offer to buy. Until then you can change or remove anything in the cart and correct every entry in the checkout form.
The contract is concluded when we confirm your order by email. That email contains the order details; you can also see them in your account at any time, and these terms stay published at this address. The contract language is English.
4. Prices and payment
Prices are in euros. [VAT statement — e.g. “All prices include VAT.” or “Under the small-business rule (§ 19 UStG) no VAT is charged.”]
Payment is by bank transfer to the account shown at checkout and in the order email, and is due when you place the order. Downloads and tokens are released once the payment has arrived — usually within one to two business days.
5. Delivery of digital content
Everything sold here is digital; nothing is shipped. A model you buy becomes downloadable from your account, in the formats listed on its product page, and stays re-downloadable there. Tokens you buy are credited to your wallet.
6. Licences for shop models
Each model is sold under the licence you select — Standard or Extended. What each licence allows and excludes is set out on the Licensing page. Buying a model gives you that licence to use it; it does not transfer the copyright in the model itself.
7. Tokens
Tokens are prepaid units used only to run jobs in the studio. They are sold in packs, or as a top-up of an amount you choose within the limits shown at purchase. The token price of each job is shown before you start it.
Tokens do not expire and nothing renews: there is no subscription. Tokens are not money, earn no interest, cannot be transferred to another account and cannot be exchanged for cash — except where these terms, the Refunds and withdrawal page or the law say otherwise. If an order for tokens is refunded or cancelled, the tokens it credited are removed from your wallet (never taking the balance below zero). Promo codes give the tokens stated with the code, under the conditions stated with it.
8. The studio
When a job starts, its estimated token cost is held against your balance. When it finishes, the hold is settled at what the job actually consumed, and any difference is released back to you. If a job fails, times out, is cancelled or is stopped by the moderation filter, the whole hold is returned to your wallet as tokens. Every hold, release and charge appears in your wallet history.
Models are generated by artificial intelligence, through our provider Meshy AI. Results vary, and we cannot promise that a job produces a particular result; a job that completes but does not look the way you hoped is not a failed job. The studio depends on that provider and on maintenance, so we cannot guarantee it is available at every moment, and the models and options it offers may change.
Your rights in the models you generate are described on the Licensing page.
9. Your content and acceptable use
You are responsible for the prompts you write and the images you upload. Upload only images you have the right to use, and do not use the studio to create anything unlawful, anything that infringes other people’s rights, sexual content involving minors, or content that incites hatred or violence. Prompts and images are checked by an automated moderation filter. We may block or remove content that breaches this section, and suspend accounts that repeatedly do.
You allow us to store and process your prompts, images and generated files, and to pass them to our provider, as far as that is needed to run the studio for you. We do not publish them without asking you first.
10. Right of withdrawal
Consumers have a statutory right of withdrawal. How it works, and when it ends early for digital content, is set out on the Refunds and withdrawal page, together with a model withdrawal form.
11. Defects
The statutory rights for digital content that is faulty or not as described apply. If a file is broken, incomplete or does not match its product page, write to info@meshyflix.com with the order number and we will put it right — by repairing or replacing the file, or, where that is not possible, by a price reduction or a refund.
12. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under product liability law. For slight negligence we are liable only for breach of an essential contractual obligation — one whose fulfilment makes the contract possible at all and on which you may rely — and then only for damage that was typical and foreseeable when the contract was concluded. [Liability clause to be reviewed by a lawyer for the governing law chosen in section 13]
13. Law and disputes
These terms are governed by the law of [country, e.g. the Federal Republic of Germany], excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not take away the protection of the mandatory consumer law of the country where you live.
[Consumer dispute resolution statement — e.g. “We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.”]
14. Changes
The terms that apply to an order are the ones published when you placed it. If we change these terms, the new version applies to orders placed after the date shown at the top.
